We collect your personal information to verify your identity, comply with AML/CTF obligations, prevent fraud, and provide you with our products and services. We are required by law to collect and verify your identity before providing certain services. Your personal information is handled in compliance with Australian privacy laws, including the Australian Privacy Principles (APPs) and the Privacy Act 1988 (Cth).

If you choose not to provide us with your personal information, we may be unable to provide you with our services and you may be subject to our Market Loss Policy (per our Terms of Trade). You can withdraw your consent before an identity check is completed.

The types of personal information we may collect include

• Your name, date of birth, address
• Identification documents such as your drivers license or passport
• Legal documents which may contain your personal information, such as a trust deed
• Sensitive information, such as biometric information

Third-party verification

We may use a third-party service provider to collect your personal information and verify your identity. The personal information that you provide to us may be disclosed to this third party, and the third party may use government-approved databases to verify your information, such as:

• The Australian Document Verification Service (DVS)
• The New Zealand Department of Internal Affairs

The information you provide will be checked against official government records. We do not receive your government records – we receive an Identity Opinion. An Identity Opinion is a general assessment of whether your details appear to match official records.

We do not use this information for marketing, advertising, profiling, selling goods or services, or market research.

We currently use MemberCheck Pty Ltd as our third-party service provider for identity verification. The information you provide will not be stored or accessed outside of Australia.

How we protect your information

We take reasonable steps to keep your information secure and confidential. Only authorised staff may access identity verification results.

We keep identity verification information only for as long as required by law.

Accessing or correcting your information

You can contact us at any time to access the personal information we hold about you (unless it would unreasonably affect another person’s privacy or a legal exemption applies), or to request that we correct your personal information if it is incorrect, outdated, incomplete, or misleading.

Complaints

If you believe your personal information has been mishandled, you can:

• Provide us with your complaint at info@libertybullion.com.au with the subject line ‘Complaint: Personal Information Handling’. The expected response timeframe is less than 14 days. We will investigate your complaint and provide a written response within the expected timeframe.
• If you are unsatisfied with our response, you can contact the Australian federal privacy regulator, the Office of the Australian Information Commissioner, to escalate the issue.

What we don’t use your information for

The information that you provide to us for ID verification will not be used for any purpose other than your identity verification, such as:

• Marketing
• Profiling
• Advertising
• Selling goods or services
• Market research

Ongoing consent

Your consent to collection of your personal information applies to all future orders, however, we may recollect your consent if:

• We change identity verification providers
• A significant period has passed, and the original consent may no longer be considered current
